TERMS AND CONDITIONS

1. DEFINITIONS

Supreme Fence and Toilet Hire Pty Ltd, ABN 58683871794, referred to in this agreement as the “Owner” or “Supreme Fence and Toilet Hire,” is the lessor of the fence materials, goods, equipment, or machinery detailed in this agreement. The individual or company, along with its authorized representative, listed in the relevant section of this agreement is referred to as the “Hirer,” or lessee, of the equipment provided by Supreme Fence and Toilet Hire under the terms outlined in this document. For clarity, the terms “hire,” “rent,” or “lease,” along with any related terms, will be used interchangeably, meaning the same for this agreement. This does not apply to the terms “Owner” or “Hirer,” or “lessor” and “lessee.” If any part of this agreement is found to be unenforceable, the remainder of the agreement will still apply. The Owner and Hirer agree that this agreement is governed by the laws of the State of New South Wales, and both parties submit to the jurisdiction of its courts. This agreement does not limit any lawful remedy available to either party, including provisions in the Trade Practices Act 1974.

2. HIRE PERIOD & CHARGES

The rental period begins on the date shown on the receipt or upon the delivery of the hired materials, whichever occurs first. The hire period ends when the materials are returned to the Owner’s premises during business hours or collected by a Supreme Fence and Toilet Hire vehicle. After the initial hire period, as stated in the agreement, the hire period will automatically extend by a minimum of one month and will be subject to an additional monthly charge for each subsequent month or part of a month.

The rental charges specified in this agreement will apply starting from the rental commencement date and continue until the specified hire period ends or the hire is otherwise terminated.

3. PAYMENT COLLECTION

Supreme Fence and Toilet Hire reserves the right to impose interest on overdue payments. The Hirer agrees to cover any costs incurred by Supreme Fence and Toilet Hire in recovering any overdue amounts, including third-party commission and legal fees. Payments are due on delivery unless otherwise agreed in writing. If the Hirer is required to pay by cash on delivery (C.O.D.), they must provide valid credit card details (type, number, name of cardholder, expiry date). By accepting the hire under these terms, the Hirer authorizes the Owner to charge the credit card for any unpaid amounts related to the hire. The Hirer’s signature on this agreement acts as written consent for such charges. This authorization remains effective until the hire ends or all outstanding payments are settled.

4. USE OF EQUIPMENT

The Hirer acknowledges that no representations were made by Supreme Fence and Toilet Hire regarding the performance or condition of the materials, equipment, or plant hired. The Hirer agrees that the Owner’s sign must be placed on every third panel and on each Portable Toilet for insurance and advertising purposes. The hired materials and equipment are to be used exclusively at the site address provided and cannot be transferred to another location or person.

The Hirer must inspect the fence and/or Portable Toilet within 24 hours of installation and immediately notify Supreme Fence and Toilet Hire in writing of any defects. Failure to notify within this time will be considered an acceptance of the equipment in its current condition, confirming that it is safe, functional, and fit for its intended use.

If any issues are reported, Supreme Fence and Toilet Hire will assess and address them at its discretion, either through replacement or repair, subject to applicable law.

Portable Toilets will be serviced every two weeks unless otherwise arranged in writing. The Hirer must ensure access for servicing; failure to do so will incur additional charges. The Hirer must specify the preferred location for placing the Portable Toilet upon ordering and ensure the site allows safe and stable placement.

The Hirer must ensure the toilet is clean and waste-free upon pickup. Any damage, dirt, or maintenance issues caused during the hire period will result in additional cleaning and repair charges.

5. DAMAGE OR LOSS OF EQUIPMENT

The Hirer is responsible for maintaining the equipment in good condition and must not alter, repair, or move the equipment without prior written consent from Supreme Fence and Toilet Hire. The Hirer will be held liable for any loss or damage, except for reasonable wear and tear. If any equipment is damaged or missing, the Hirer agrees to pay the replacement or repair costs, as determined by Supreme Fence and Toilet Hire. The Hirer is also liable for ongoing hire charges until equipment is returned or replaced.

7. INDEMNITY

The Hirer agrees to indemnify Supreme Fence and Toilet Hire against any claims, damages, losses, or expenses arising from the use of the hired equipment, including the Portable Toilet, while it is in the Hirer’s possession.

8. TERMINATION BY OWNER

Supreme Fence and Toilet Hire reserves the right to terminate the agreement at any time, regardless of the specified hire period, in the following circumstances:

a. If the Hirer takes actions that undermine the Owner’s rights to the equipment.
b. If the Hirer becomes bankrupt or enters into arrangements with creditors.
c. If the Hirer fails to make payment or breaches any other term of the agreement.

The Owner may enter any premises where the equipment is located to recover the equipment or pursue payment, and the Hirer indemnifies the Owner for any claims arising from such actions.

9. TRANSFER OR ASSIGNMENT

This agreement may not be transferred or assigned to any other party without prior written consent from Supreme Fence and Toilet Hire. Any unauthorized transfer or assignment may result in immediate termination of the agreement, with the Hirer still responsible for any fees incurred.

10. INFORMATION PROVIDED

The Hirer confirms that all information provided is true and correct. If any details are found to be incorrect, Supreme Fence and Toilet Hire reserves the right to terminate the agreement and recover the equipment at the Hirer’s expense. The Hirer is responsible for any costs incurred due to incorrect information.

11. IMPORTANT NOTICE

If no extension is required, the Hirer must notify Supreme Fence and Toilet Hire at least 7 days before the rental period expires. Off-Hire Notices must be submitted via email or SMS. If Supreme Fence and Toilet Hire does not receive a notice, the agreement will automatically continue on a month-to-month basis at the re-hire rate.
